What Are The Most Common Catastrophic Injuries?

Catastrophic injuries often cause permanent disability as well as disfigurement. You may be unable to work, care for your family or enjoy your life as you used to.

Is There A Limit To The Amount Of Compensation I Can Recover For An Injury Claim?

In most personal injury cases in Indiana, there is no cap on economic damages, but noneconomic damages are capped at $500,000 per person (Ind. Code § 34-51-2-3). Punitive damages have a cap of three times the amount of the economic and noneconomic damages combined or $50,000, whichever is more.

In Kentucky, under most circumstances, there is not a set limit on economic damages or noneconomic damages. There is also not a limit on the amount of punitive damages you may receive.

With the cap on noneconomic damages in Indiana, your recovery may be limited compared to a case in Kentucky. And, while punitive damages are rare, you could potentially recover more in Kentucky.
